Diversion from prosecution scheme - A to Z
The Procutator Fiscal can request a Diversion Report from the Criminal Justice Team when he/she believes that the person who has been charged does not necessarily need to be prosecuted in Court.
Diversion is most often used for young/first offenders, for minor offences or where there is no overriding public interest for a prosecution and the person who has been charged agrees that they have committed the offence as charged.
A Criminal Justice social worker will prepare a diversion report and, if the Procurator Fiscal agrees, the person may work on any problems with Criminal Justice or another agency instead of going to Court.
