Right to Buy

With a few exceptions such as tenants of sheltered houses, secure tenants have the right to buy their homes.

The Housing (Scotland) Act 2001 changed the terms under which people taking on a tenancy after September 30th 2002 can purchase their homes. Tenancies begun after this date have the modernised right to buy. The qualifying time for this is a continuous five-year tenancy of the house and the maximum discount is 35%, or £15,000 whichever is the lower.

If you had the right to buy before 30 September 2002, the conditions you enjoy (including a discount and eligibility period) will not change as long as you continue to stay in the same house. Further details and application forms are available from local council offices. An explanatory leaflet is also available, which you can find on the right hand side of this page.
