Data Protection & Smartcards

There are legal requirements in place when it comes to collecting and using personal information (“data”), these requirements are laid out in the Data Protection Act 1998. East Lothian Council already holds a wide range of data on individuals for specific purposes. The collection, storage and use of this data is carefully monitored in line with the Data Protection Act.

A certain amount of personal data is required to allow us to offer smartcards to people in East Lothian. We have made sure that the way we collect and process personal data for our Smartcard Project complies with the Data Protection Act.

Data Protection Information
Under the terms of the Data Protection Act, there is certain information that we need to make available where personal data is processed by East Lothian Council :

  • The identity of the Data Controller is East Lothian Council; 

  • Your personal data will be used to administer the East Lothian Smartcard Project. This will include processing applications, issuing smartcards and dealing with enquiries (for example, if your card is lost or stolen). The use of your personal data is also necessary to enable us to offer access to specific Council services via smartcards; 

  • In the future, we may add further uses to your smartcard. In order to do this, we will share information with our smartcard partners unless you have specifically asked us not to share this information.

Our Smartcard Partners
We will only share your personal data with partner organisations for the purpose of introducing additional uses to your smartcard (for example, if we made it possible for smartcards to be used on public transport, we would need to share certain personal data with transport operators). At the moment, East Lothian smartcards are only used to access East Lothian Council services. This means that the East Lothian Smartcard Project does not currently share any personal data with partner organisations. If this situation changes in the future, details of partner organisations will be posted here. You can also request a copy of an up to date list of partners from the Smartcard Office at any time (contact details are given below).

Viewing Your Data
Under the Data Protection Act 1998, you have a right to see, and correct, any personal details that are held on computer. You can do this by contacting :
