EAST LOTHIAN LICENSING BOARD

LICENSING (SCOTLAND) ACT 1976
NOTES FOR GUIDANCE

Applications for Grant, Provisional Grant of Licence or Provisional Site Only

1. This application form requires to be completed for Public House, Hotel, Restaurant, Refreshment, Restricted Hotel, Off-sale or Entertainment Licence.

2. Applications require to be lodged not later than 5 weeks before the Board Meeting together with the fee payable:-

 Grant  £172.00
 Provisional Grant     £138.00
 Provisional Grant – Site Only   £138.00

3. Applicants must lodge Certificates of Suitability from Planning, Building Control and Food Hygiene (Section 23 Certificates) or give an undertaking to produce these prior to the hearing of the application. 

(Not applicable for Off-sale Licence applications).

Please note these certificates should be applied for by writing individually to each of the aforementioned departments.

4. Applicants must submit one durable and four paper copies of a plan of the premises for application.

(Not applicable for Off-sale premises unless application is for Provisional Grant of Off-sale Licence).

Please note that the plans should show:-

(a) The location of alarm systems, smoke detectors, emergency lighting and other fire precautions equipment.

(b) The location of all food and sanitary fixtures and fittings.

(c) All ventilation systems.


5. A site notice must be displayed at the premises for a period of 21 days.

6. Applicants must notify all neighbours in the same building about the application.

7. Full Grant of Licence lasts for 3 years and a Provisional Grant of Licence lasts for 1 year only.
