Appeals

If the Board grants a New Licence despite your objection you may appeal to the Sheriff but you are not entitled to this if you did not attend the Licensing Board.

The Sheriff must receive your appeal either within 14 days of the meeting or if you request the reasons for the Boards decision within 14 days of your receipt of the Clerk’s response.

The Sheriff can only overturn a decision made by the Licensing Board if he considers that the Board:-

(a) erred in law,
(b) based its decision on any incorrect material fact,
(c) acted contrary to natural justice, or
(d) exercised its discretion unreasonably.

There is no right of appeal against a grant of regular extensions of permitted hours.
