If a premise has an existing liquor licence and the licenceholder has changed then applicants are advised of the following:-
There are two different ways to transfer a licence – firstly you can apply to Transfer a Licence in a one step Permanent or secondly you can in a two step process, Temporarily Transfer the licence and then apply to make this Permanent.
Temporary and then Permanent
The Temporary Transfer Application requires to be lodged at least 14 days prior to the date requested, this application is dealt with under delegated powers (by the Clerk to the Licensing Board and does not go to the Board Meeting). This application if granted has effect until the next meeting of the Board or if transfer has been made within 6 weeks of the Board Meeting the next meeting of the Board. This application is not advertised in the press. The Board request that the applicant obtains a letter of consent to the transfer from the previous licenceholder and this is submitted to the Board.
Permanent Transfer
The application must be lodged no later than 5 weeks before the Board Meeting. This application is not advertised.
SUBSTITUTION OF AN EMPLOYEE
Where a licence is held by a company and an individual any application to substitute a new nominee must be granted within 8 weeks from the time when the employee named in the licence ceases to be responsible for the day to day running of the premises. This application is dealt with under delegated powers. This application requires to be confirmed at the next board meeting. This application is not advertised.
