Private Tenants Guide

Private tenancies are governed by different laws from those in the public sector. They are not covered by the new Scottish Secure Tenancy, introduced by the Housing (Scotland) Act 2001.

If your tenancy began after January 2nd 1989, it will be regulated by the Assured or Short Assured tenancies, introduced by the Housing (Scotland) Act 1988. The most common form of private tenancy before January 2nd 1989 was the Regulated Tenancy.

The law surrounding tenancies of all types is complex and you are advised to seek help from a Citizen's Advice Bureau or a solicitor. However we have provided a number of guides and leaflets here, which may answer some of your questions or point you in the right direction.

The Scottish Government has produced a Private Tenants Guide which covers many eventualities from rent setting, through deposits to unlawful eviction. You can find it here.

The Scottish Government also offers a website to help landlords and tenants, called Better Renting Scotland.
