What is Frank's Law?

On 1 April 2019, the Scottish Government is introducing 'Frank's Law'. This means adults under the age of 65 may also claim free personal care. Free personal care previously used to be for people aged 65 and over.

What is personal care?

Personal care includes things like assistance with dressing, feeding, washing and toileting.

What does this mean for you?

If you are aged under 65 and have a care package from us that includes personal care, the new law may change what you pay for your services.

From 1 April 2019 you will no longer be charged for any part of your service that is assessed as personal care. You will only be charged for non-personal care part of your service.

If you think you should be receiving free personal care but have not been referred to us before, please contact us on 01875 824 309 and ask about getting a referral.

Charging for non-personal care services

We will continue to financially assess anyone who uses non-personal care services arranged by us. This allows us to work out how much they should pay in charges towards the cost of their care.

The current maximum charge is £15.26 per hour. Most people we financially assess pay a lot less than this amount.

Help with the cost of charges for this service is limited to people who have savings of less than £16,000. This is in line with our charging policy.

Other services not covered by free personal care or your financial assessment

If you use other services arranged by Adult Social Care not covered by the revised free personal care policy or your financial assessment, we will continue to invoice you for these as usual. These services include council day centres, meals and the community alarm service.
