Musselburgh man evicted following drug conviction
East Lothian Council has evicted a tenant for breaching his tenancy agreement after being convicted of being concerned in the supply of a controlled Class A drug.
On 3 March 2016 police officers stopped Kristoffer McAuley’s car outside of his home at 6C Bellfield Court, Musselburgh. Half a kilogram of diamorphine, with an estimated street value of £45,000 was recovered, along with £10,000 in cash. On 24 November 2016, Mr McAuley (35) was convicted of an offence of contravening section 4 (3) (B) of the Misuse of Drugs Act 1971 and was sentenced to 3 years imprisonment.
Following an application by East Lothian Council, an eviction order against Mr McAuley was granted on 1 September 2017. The Council had argued that its tenant had breached the terms of his tenancy agreement by committing the offence. Mr McAuley’s property was recovered on 24 October 2017.
Cllr Jim Goodfellow, Cabinet member for Housing and Community Wellbeing, said:
“The Council recognises the corrosive impact that drug dealing has on local communities and will look to enforce the terms of its tenancy agreements in the appropriate circumstances. Using or allowing a council property to be used for illegal purposes such as drug dealing is a clear breach of our tenancy agreement.”
