Dog fouling

One of the most common complaints we receive is about the unacceptable behaviour of some dog owners who do not clean up after their dog when it has fouled in a public place.  This shows little or no respect for the health and wellbeing of others, and leave dog mess where people can easily step in it or come into contact with it.

The Dog Fouling (Scotland) Act 2003 makes it an offence if someone fails to immediately remove their dog’s faeces in a public place without a reasonable excuse.

Our Community Protection Officers can issue Fixed Penalty Notices or Recorded Warnings if they see owners failing to clean up after their dogs.  Action can also be taken if you see a dog owner not cleaning up and provide us with a witness statement.

Promoting responsible dog ownership

We are keen to promote responsible dog ownership. We do this by:

  • telling dog owners about their responsibilities
  • taking enforcement action against offenders
  • giving talks to primary school children
  • putting dog waste bins at various places throughout East Lothian
  • putting up "No Fouling" signs
