4.3 Legal bars to voluntary management

There are no specific legal bars to being a member of the management committee of an unincorporated voluntary association that does not have charitable status.

The prohibitions kick in when an unincorporated voluntary association either incorporates or gets charitable status or both.

Company law, and various other laws that affects companies and/or their directors, contain criteria that disqualify someone from being a company director. For details contact Companies House.

The Charities and Trustee Investment (Scotland) Act 2005 specifies who is disqualified from being a trustee of a charity in Scotland.
