Roads - adoption agreements

How roads become adopted for maintenance purposes

A common way of creating new roads is by an agreement under Section 21 of the Roads (Scotland) Act 1984 between developers and East Lothian Council as Roads Authority.

These agreements are called Road Construction Consents, and are most often made with housing developers who agree to build the road to standards laid down by the Roads Authority.

In return, the Council agrees to adopt the road and to maintain it thereafter as a public road.

Until a road has been adopted it remains private and the responsibility of the developer or house owner.
